    yes - I think the only difference is that you cannot use the approved AP to come in.

    If you use H1B to enter u shd be ok... dont try to come in with the AP

    I was in a similar situation, and they got my PP H1 because of my overseas travel.

    If you get a H1 extension before you travel, you can show the new H1 (I-797) at the POE and the inspector will stamp Mar 08 on your new I-94.

    If your H1 is not approved by the time of your return, you can have Mar 07 on your I-94, and your extension approved thereafter is valid. The I-797 will have a I-94 that'll be valid till Mar 08.

    The gray area, it seems, is if your H1 is approved when you are outside the country. In that situation, apparently, you need to get a visa stamp before you re-enter US. If you think that you could be in this situation, check with an attorney. I think they call this the "Last Action Rule".

    I have my H1-stamping and I-94 valid until March 07, My H1 extension was applied during Nov - 06, but not approved yet....In the mean while, can I visit India and return by Feb 07 ? On my return, I will still get my I-94 till March 07, but Once my H1 extension is approved it will have the I-94 attached to it till Mar 08, is this I-94 valid ?

    My employer is saying that, the new I-94 that I got from my H1-extension is not valid and they have to file a new H1 OR I have to convert the H1 extension to Premium and travel with the approved H1 extension ?

    Consult a good lawyer, prepare an appropriate reply based on true situation. If they feel that the request is genuine, they will approve else be prepared for the worst.

    To be frank, i don't think any company like the one you explained even exists! I will be surprised if it does, and if it does I won't wonder if there is no RFE in the current enforcement days from USCIS.

    Thanks for your reply.

    I thought by using EAD i will save my 6 months on H, incase anything goes wrong with 485 i still hv 6 months on H left.

    looks like its a grey area .... will differ it to opinion from any lawyers.

    I have a PD of April 2008 in the EB2-I category, but am exploring the option of switching to EB1 if possible. I am a clinical psychologist, working in a not-for-profit agency. What are my chances? Does it depend more on the case itself or a really good lawyer who can present your case in the best way it can be presented? This is a really stressful situation because my husband's H1-B runs out next summer and we cannot live here on just my income. Any feedback?

    I believe the case itself is the major factor. The credentials/publications/patents + solid letters of recomendations etc is the major factor. The attorney can advice you on the types of letters or proofs that are required to substantiate your case but not more. And ofcourse once you have decided that you could potential go for the EB1, I would certainly ask others for attorneys who have had more success in EB1 cases. The "good" attorney will evaluate your total package and asks you for more documents if it is not good enough. Others will take your money and all material you send and just send it over to the CIS.

    My 485 is pending, so I think I won't be totally out of status..

    Any suggestion on how we can approch sending the approved LCA later and ask USCIS to match it to the already submitted H1B petition?

    I dont see a problem if you have I 485 Pending ( i assume you have EAD to continue working )

    I filed my H1B 3 months later after joining a new job on EAD , i didnt have any problem

    I am working on an H1B visa for one of the world's largest retailers. I am in my 5th year of my H1 visa status and it expires in 2011. If an LCA is filed before July 2010 which is a 365 day point I will be allowed to extend my H1 for another 3 years while my Green Card is in process.

    The situation is that the advertisement has been done in NJ and they received 100 applications which makes it difficult to support their statement of me being the most capable one beyond all US citizens. So they have decided now to advertise once again in a remote location in NJ and another in VA. Is it ok to file the LCA for a single employee from 2 different locations. Are there any risks involved? Do I need to move to VA in case it is approved before the whole process is done? or can it be avoided till I get my Green Card as I'm working for the same employer in a different state?

    Any info and advice is much appreciated.

    Hi all,


    This is my first post here, if it is not in the appropriate location please excuse me.

    My company filed my I-485, EAD and AP together.(On Auguest 6th this year) They asked me for only one check for $745.
    I was reading through a few posts and found that everybody had submitted 3 individual cheques for the same...
    Is this ok? Or did my company do a blunder.
    I have not yet recieved any receipts.

    Hi

    I lost my job in January and since I was not able to get a new project. So, returned back to India in May'09. My AP was valid till 21-July-2009. I did not file for extension while in US.

    Now, I am getting a job in US and the employer is asking if I could join immdiately. Please let me know:

    1. If there is any option for me to renew my AP from India?
    2. Any other options, since my H1B got expired (6 years) in May'09.

    Note: My EAD is valid till June 2010.

    Can you get a SSA benefit if you don't have a GC? Isn't that a Catch 22?

    Well I dont get SSI benefits but is there a way we can convince USCIS to expedite cases that meet the first condition?

    I am on H1b but i was thinking if we can easily convert to f1 student visa or h4 visa dependent.

    how much fees it takes to convert.

    and can we convert back to h1b after being on h4 visa. it is esay to convert now a days?

    My AP was approved Nov 16. Email from USCIS said approval notice sent. I had to travel Dec 4th. When my lawyer contacted USCIS on Nov 25th, USCIS said they were in the process of printing the form. My lawyer suggested trying for the emergency AP. The Baltimore office says walk-ins not allowed. My travel was postponed for other reasons. Double check that USCIS actually mailed the notices to you.
