Guess its easier.. and then they give negative reps instead of answers... Anyway.. Seems IV is losing focus and with this attitude of majority.. many more will go away...
I'll request all contributors to feel proud but don't boast all the time of your contributions and expect contributions from the others rather than questions...
I expect more negative.. as this is the latest trend in IV.. Anyway... where there is a will.. there is a way.. So I'll find my answer :-) and will continue answering folks who need... People will contribute at their pace and in the manner they feel good... You just can't force them... without being an example...

I�m in EB2 and My I-140 was approved on March 2009 through Employer A. After which I moved to India and now am back (Nov 2010) with Employer B. My old Employer A has my apporved I-140.
It would be great if I get answer the below my Question:
1. Can I apply for I-485 with my new employer B based on my approved 140?? OR
2. Do I need to go back to my old employer A to apply my I-485. If yes is there any specific time period to go back to my old employer A.

1. Since you are asking the question for applying for I-485 with employer B, I presume that you have not filed for I-485 with employer A. If this is the case then you will have to apply for new labor. Once you have new labor approved, then you will have to apply for I-140. You will be able to maintain the same priority date from the old approved I-140 (please make sure you have a photocopy of approved I-140 from employer A).
Now, if in case you had already filed for I-485 with employer A and the case has been pending for more than 180 days, then you can switch jobs using AC21.
2. I do not personally feel that there is any need to go back to the old employer to file for your I-485.

It's really hard to get visa. You should hold green card to bring your spouse to united states or else its tough. Maybe you can ask your wife to come through F-1 visa, you both can purse your studies and also stay together. The other option is to go through visitors visa, but in inteview they might ask questions make sure you people answer honestly.

Can you please help me figure out how to calculate the eligibility for citizenship. If one married a US citizen. Obtained conditional residency, the temporary green card, then forgot to apply to remove conditions. So re-applied for green card, and was granted. The parties have been married 5 years. Will the initial 2 years spent as a conditional resident count towards the 3 years for the citizenship? Again, I want to stress out that after the initial 2 years in conditional permanent residency, forgot to remove conditions, and a new application for green card was needed. However this time the permanent green card was given. Or will she have to wait another 3 years from now on with the permanent green card until applying for the citizenship?

My wife and I will be Canadian Permanent Residents in a few months. I am on EAD with I485 pending and have AP. She is on H1B
We will need to Travel to Canada for Immigrant Landing formalities after we get PR.
How can we enter back in US so that my AOS and her H1B Status is not affected?

I am planning to use AC21 by joining a company on this March month end , I asked new company to process H1, and its in progress.
In APRIL Visa Billiton my PD is current, as I have PD of JUNE 2001( EB2), my RD - JUNE 29, 2007 .at this stage if I change company what is the impact on my GC approval. Should I wait for some more time to join the new company?

Hi, I am an Indian citizen working on a H1b visa. I need a Canadian tourist visa (TRV). I am planning to go to the Canadian consulate in Detroit. Would you know if Canadian Detroit consulate allows walk-in visa appointments. Is there any specific day or time when they permit walk-ins and how long does it take to get stamping. If Detroit does not, does consulate at Seattle or Buffalo allow walk-ins.

I was employed by company A until from 2004 thru May'07 with labor and I140 approved in 2006, I was laid off from Company A in May'07 therefore I joined company B in June (transfered my H1).
In July , Company A agreed to file my I485 under future employment as all the EB catagories became current but I still work for company B (H1 with company B), now since in Jan'08 it will be past 180 days on my 485 application.
Can I file AC21 to change my employer to Company B and continue my I485 through to Company B?
Answer is Yes. Company B should be prepared to confirm that they have a job (same/similar as in original LC) which they will offer you on permanent basis upon your getting GC. Note that current job with B is on H1 (means it is not permanent).

masala_dosa, this is my understanding. once you have applied for EAD, its your responsibility to keep it valid all the time, independent of if you are using the EAD or NOT. You have to appy for renewals before it expires etc. i dont know if it impacts the current gc process or not.
two scenarios:
If you are using EAD for your current job, and if you did not renew ( or alteast file for renew) before it expires you may notbe able to continue the job.
If you are NOT using EAD, but have an EAD on hand you are supposed to keep it valid.
once again - im not an attorney and all above were my understanding.
why dont you talk to your attorney. he/she may have a simple answer for this.

Here are few pending immigration bills which have a higher chances of passing in both house and senate. I was looking at some of the bills and noticed when a bill (or a varient )is introduced in both houses simultaneously the chances of that bill passing are higher.
This may be a good idea for us to try pushing some of the EB related measures if we can
into these bills. I know someone may say Hey these are family related bills But remember how they add the immigration, healthcare, veteran measures into budget or appropriation bills.....similarly we can try.
1 . Uniting American Families Act of 2009 (Introduced in Senate)[S.424.IS]
2 . Uniting American Families Act of 2009 (Introduced in House)[H.R.1024.IH]
This bill and varient were introduced in both house and senate. Note: It touches the
SEC. 4. NUMERICAL LIMITATIONS ON INDIVIDUAL FOREIGN STATES This is one item we always talk about removing the country limits......
The other bills in progress are
3 . Immigration Fraud Prevention Act of 2009 (Introduced in House)[H.R.1992.IH]

If new position is similar in responsibilities, then no effect. but if the responsibilities are changing, I would recommend talking to your immigration lawyer about it
