Please someone tell me whether Ac21 portability 180 days rule applies from the day USCIS receives the application or whether it starts from day you get I-485 Receipt #????
In our case USCIS recieved our application on July 2nd and we have not received receipt # yet. so 180 day clock starts ticking on July 2nd?

To be clear When you say "packets" should i put them within two envelopes?
I was planning on just putting the documents(application and supporting docs) bound by paper clips.

Yes. One envelop for AP and the other one for EAD. Put both envelops in Fedex envelop.

I got RFE on 485(field in Dec 2004) in last month for TB Skin test and employement letter. My PD is not current but INS is processing my application. I am waiting for physical notice from attorney. I have dependent whose AOS is not filed now I can not file due to retrogression.
With July bulletin my PD becomes current I am ready to file AOS to my dependent. Offcourse not sure that once I submitted to attorney how soon he will send to USCIS.
I have question that which one is best option to file dependet's AOS?
Submit dependent's AOS with evidences to RFE ? Means in same cover?
or

Please advise.

Hello, I've been offered a job and have less than 180 days since applied for I485. I have EAD document thourgh my wife as well.
In case I accept the job offer do I need to withdraw my pending I485?. If will work part time with my current employer will my application be affected in any way?

My Lawyer asked for the original letter from employer. She didn't even accept the scanned copy. I had to mail the letter to my lawyer.

If it is new 485 filing then you don't have A#.
A# on I-140 is nothing do with your 485.
Its has everything to do with 485 if its the alien # alloted to you at 140 stage and begins with a 0 (zero) thats your permanent alient number wont change for life.
But as far as not mentioning it is no big deal as your paperwork includes I140 copy or original whatever and shouldnt have any negative impact on the filing.

Are you in touch with your dad now? If not, you'll have to get back in touch with him, sort out your issues, and then maybe you'll both reconcile and he'll get an immigration lawyer to help you with your green card.
If you're already back with your dad, then consult an immigration lawyer immediately.
How long has it been since the appointment date? I'm not an expert, but if you don't show up to the appointment then your file is considered abandoned.

You are not limited to change job within the same corporation. However you are limited to changing the job within same or similar occupation.
Old company can revoke I-140 since it is their application. They can not revoke I-485 since it is your application. You may get RFE to show that you are still employed in same/similar occupation but that's about it. You don't need to start all over or lose your place in the queue.

My wife was in US in Oct 2007 on H4 Visa and went back in Mar '08 while she was in US we applied her H1B in 2008 and was approved and she got her H1B stamped in India and came back to US in Oct 2008. since she did not find any job, her payroll is not running and the her employer wants her to switch back to H4 Visa, and once she finds a project she can change her status back to H1B.
My Question here is
1) For COS from H1B to H4, Does she need Pay stubs? and how easy it is for the COS?
2) Her Employer says that she can apply for H4 Stamping and inform the Visa Officer that during her stay in US she did not join the company for medical reasons. Does this create any issues with her H1B.
3) Can Some one suggest a good immigration Lawyer in San Diego?

Your I - 94 Validity cannot be at a date later than H1-B. You say you got your first H1B visa till Oct 2005, but I - 94 expires in Nov 2005. I donot think it can happen
Third country Nationals can go to Mexico and get thier Visa stamped. The only thing is if your Visa gets refused for some reason, you will have to fly back to home coutry and get it stamped.
Have not heard such cases though.

Here is something we really should watch closely. US senate race in Massachusetts between Democrat Coakley and Republican Brown. They are fighting for the vacant seat of Hon. Late Senator Ted Kennedy. Now, people would think, why a race in mass. matter? It's a completely blue state, and had no republican senator in last 40 yrs, obviously a democrat would win. The election is on tuesday and the ground reality seems to suggest something else.
This seat is crucial for President and Democrats as it is the much coveted 60th seat in the senate to get a filabuster-proof majority which democrats have enjoyed so far. It is critical for healthcare reform as well as for immigration reform (if at all it comes).
The gap between both the candidates was narrow with democrat leading but today, for the first time, polls indicate that Brown has taken lead over Coakley. People in this blue state seem to increasingly support Brown, mainly frustrated because of healthcare policies. Mass residents already have a healthcare related tax to help run state's universal health care. On top of that, federal health overall would be adding more taxes on people and people fear that they will end paying both. Already, mass is a very high tax state. So, there is an increasing popularity to tax-related fiscal conservative campaign run by Brown.
This is surely gonna be a nail-biter; so let's wait and watch this one. Election is coming tuesday.
